Terms of Service

Please read these Terms of Service carefully before using the Developedbytyre platform. These Terms constitute a legally binding agreement between you and Developedbytyre. By using the Service you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and hold all required insurance licenses for the jurisdictions in which you operate.

1. Acceptance of Terms

By accessing or using the Developedbytyre platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including individual insurance agents and agency owners. Use of the Service constitutes acceptance of these Terms and our Privacy Policy.

2. Description of Service

Developedbytyre provides an AI-powered outbound dialing platform that: • Places automated outbound calls to leads on your behalf using AI voice agents. • Qualifies prospects and routes interested leads to you as live transfers. • Books future appointments with prospects. • Provides call recordings, transcripts, and campaign analytics. • Manages outbound dial campaigns with up to 5 simultaneous dial lines. The platform is intended exclusively for licensed insurance agents and agencies operating in compliance with applicable law.

3. Payment Terms

The Service is billed on a usage-based model with no monthly fee: • Individual agents are billed at $0.49 per conversational minute. • Agencies are billed at $0.39 per conversational minute (volume discounts available). • Live transfers, booked appointments, voicemail drops, and other non-conversation events are always free. • Usage is metered and billed automatically. Charges accrue against your account balance and are collected daily. A valid payment method must be on file to use the Service. If a payment fails, access to dialing may be suspended until the balance is cleared. No refunds are issued for conversational minutes already used. If you believe a billing error has occurred, contact us within 14 days at tyre@developedbytyre.com.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including but not limited to: • The Telephone Consumer Protection Act (TCPA) and all FCC regulations governing outbound calls. • Do-Not-Call (DNC) registry requirements at the federal and state level. • State insurance solicitation laws and licensing requirements. • CAN-SPAM Act and any applicable email marketing laws. You are solely responsible for ensuring your lead lists and calling campaigns comply with all applicable laws. Developedbytyre provides the technology — compliance is your responsibility.

5. Prohibited Uses

You may not use the Service to: • Contact individuals on the National Do-Not-Call Registry without a valid exemption. • Make calls that violate the TCPA, including to numbers requiring prior written consent that you do not have. • Engage in spam, deceptive, or misleading communications. • Impersonate any person or entity or misrepresent your affiliation with any organization. • Conduct calls for industries or product types not permitted under your license. • Harass, threaten, or abuse call recipients. • Reverse engineer, scrape, or attempt to extract proprietary platform code or AI model data. • Resell or sublicense access to the platform to third parties without written authorization. Violations may result in immediate account suspension without refund and may be reported to regulatory authorities.

6. Termination

Either party may terminate these Terms at any time. You may cancel your account by contacting support. Upon cancellation, your access to the Service will end and any unpaid balance will be due immediately. We reserve the right to suspend or terminate your account immediately, without notice, if: • You violate these Terms or our Acceptable Use policy. • We are required to do so by law. • We determine that your use poses a risk to other users or to the platform. Upon termination, your data will be handled in accordance with our Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by law, Developedbytyre shall not be liable for: • Any indirect, incidental, special, consequential, or punitive damages. • Lost profits, lost revenue, or loss of business opportunities. • TCPA violations, DNC violations, or other regulatory penalties arising from your use of the platform. • Outcomes of calls, including transfer rates, close rates, or appointment show rates. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the total amount you paid us in the three months preceding the claim. The Service is provided "as is" without warranty of any kind, express or implied.

8. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-platform notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
